Terms of service
Channel Clarity is operated by Channel Clarity Inc, a Georgia corporation ("Channel Clarity", "we", "us"). These terms govern your use of channelclarity.com and, where you are a customer of a business that uses Channel Clarity, your receipt of messages through the service. By using the site or receiving messages you agree to them.
1. This website
channelclarity.com describes the Channel Clarity service. Content is provided as is and may change without notice. Submitting the demo form asks us to contact you about Channel Clarity. It does not create an account or a contract, and we may decline to offer a demo.
2. The service and who is responsible for what
Channel Clarity is a messaging and visibility service for businesses. A business that uses it is the sender of every message it sends. The business is responsible for the content of its messages, for having its customers' consent to contact them, and for following the laws and carrier rules that apply to business messaging, including the Telephone Consumer Protection Act, the CTIA messaging principles, and state law. Use of the service by a business is governed by the agreement that business enters into with Channel Clarity, which controls over anything on this page where the two conflict.
3. Messaging terms for customers of a business
- You receive messages because you gave the business your number and agreed to be contacted, for example by requesting a quote, booking a job, or replying to a message.
- Message frequency varies by business and by job. Message and data rates may apply.
- Reply STOP to any message to stop receiving texts from that business number. Reply HELP for help, or email hello@channelclarity.com.
- Carriers are not liable for delayed or undelivered messages.
The full SMS policy has the details.
4. Acceptable use
The site and the service may not be used to send unsolicited messages, to harass, threaten, deceive or defraud, to send unlawful content, to impersonate another person or business, to probe or interfere with the service or its providers, or to collect data from the service without permission. We may suspend a number, an account or access to the site when we believe this has happened.
5. Third-party systems and names
Channel Clarity connects to customer relationship and field service systems such as ServiceTitan, Housecall Pro and Jobber under those providers' terms. Those names and marks belong to their owners, who do not sponsor or endorse Channel Clarity. Connecting a system is at the business's direction and under its own license with that provider.
6. Our content
The text, design and code of this site belong to Channel Clarity. You may read and link to it. You may not copy it for a competing offer or present it as your own.
7. No warranty
The site and the service are provided without warranty of any kind, express or implied, to the extent the law allows, including warranties of merchantability, fitness for a purpose and non-infringement. We do not promise that the site will be uninterrupted or error-free.
8. Limitation of liability
To the extent the law allows, Channel Clarity is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from use of the site or receipt of messages. Our total liability to a visitor of the site is limited to one hundred U.S. dollars. A business's remedies are set out in its agreement with us.
9. Privacy
How we handle personal information is described in the privacy policy, which is part of these terms.
10. Changes
We may update these terms. The date at the top shows the current version. Continued use of the site after a change means you accept it.
11. Governing law
These terms are governed by the laws of the State of Georgia and applicable federal law of the United States, without regard to conflict-of-law rules. Any dispute arising from them will be brought in the state or federal courts located in Georgia, and you consent to their jurisdiction.
